The State Administration for Industry & Commerce (SAIC) of the People’s Republic of China is the competent authority of ministerial level directly under the State Council in charge of market supervision/regulation and related law enforcement through administrative means.

 

With creating a regulated and harmonized market environment of fairness, justice and faithfulness for the coordinated socioeconomic development as its objective, SAIC functions in maintaining market order and protecting the legitimate rights and interests of businesses and consumers by carrying out regulations in the fields of enterprise registration, competition, consumer protection, trademark protection and combating economic illegalities.

 

SAIC also takes charge in business coordination among local Administrations for Industry and Commerce (AICs) at/below provincial level nation wide, and gives relevant guidance thereof.

 

Our responsibilities

1.     Regulate the market through administrative enforcement, draft relative laws and rules, and make regulations and policies on administration of industry and commerce.

2.     Carry out and administer registration of enterprises (including foreign-invested enterprises), agricultural cooperatives, entities or individuals engaged in business operation and resident representative offices of foreign companies; and take charge of the investigation and ban on unlicensed business operation according to law.

3.     Regulate and maintain market order according to law; regulate market transactions and online transactions in goods and services.

4.     Regulate product quality and food safety in the market; protect consumers’ rights and interests in the service sector; investigate and punish irregularities such as counterfeiting, faking and inferior quality; guide the acceptance and handling of consumer inquiries, appeals and complaints, and instruct the development of related networks thereof; protect legal rights and interests of business operators and consumers.

5.     Investigate and punish illegal direct selling and pyramid selling cases; regulate direct selling businesses, direct sellers and their direct selling activities according to law.

6.     Enforce the antimonopoly law with regard to monopolistic agreements, abuse of market dominant position, and practices to eliminate or restrict competition through abuse of administrative power (excluding price monopoly); investigate and punish economic irregularities such as unfair competition, commercial bribery, and smuggling according to law.

7.     Regulate brokers, brokerages and their broking activities according to law.

8.     Carry out administrative supervision over contracts and auctions, register chattel mortgage, and investigate and punish illegal acts such as contractual fraud.

9.     Guide development of the advertising industry and supervise advertising activities.

10. Take charge of trademark registration and regulation, protect the exclusive right of trademark, investigate and punish any infringement thereof; handle trademark-related disputes; reinforce efforts to recognize and protect well-known trademarks; register, file, and protect special marks and official marks.

11. Organize and instruct credit rating of enterprises, self-employed entrepreneurs and commodity transaction markets; analyze and publish basic information about incorporation registration and trademark registration of market players, and thereby provide information service for government decision making and the public in general.

12. Serve and regulate self-employed entrepreneurs and private enterprises.

13. Conduct international cooperation and exchanges related to the functions of SAIC.

14. Lead and guide operation of local Administrations for Industry and Commerce (AICs) nationwide.

15. Perform other tasks assigned by the State Council.
